A welfare check Monday night in Chillicothe resulted in the arrest of a man on charges of disorderly conduct and drug paraphernalia possession.
According to the Chillicothe Police Department, officers were dispatched around 9:04 p.m. on Aug. 3 to the 1000 block of Columbus Street after reports of a man who appeared to be “tweaking” in the courtyard of a multi-dwelling property.
When the officer arrived, he found the man sitting on the ground, reportedly muttering that people were trying to get him. The report states the man was having difficulty putting on his shoe and was exhibiting jittery, compulsive movements while sweating heavily.
Police identified the man as Kirk Evans. During the encounter, Evans reportedly continued making repetitive hand and leg movements and bounced from one foot to the other while speaking with the officer.
After asking whether Evans had any weapons, the officer conducted a pat-down and reported finding a short plastic straw and a folded piece of foil containing both burnt and unburnt residue in his pants pocket. Based on the officer’s training and experience, the items were believed to be associated with narcotics use.
Following a Miranda warning, Evans allegedly told police he did not use narcotics and claimed the paraphernalia was used for “dabs” from marijuana.
The officer reported that Evans’ behavior was consistent with multiple signs of amphetamine use. Evans was taken into custody without incident and transported to the Ross County Jail, where he was booked on charges of disorderly conduct (intoxicated annoyance or alarm) and drug paraphernalia. The paraphernalia was collected as evidence.
As with all criminal cases, the charges are allegations, and the defendant is presumed innocent unless proven guilty in court.
