A 20-year-old Chillicothe man was booked into the Ross County Jail early Tuesday morning after allegedly attempting to evade officers during a disorderly conduct investigation and then providing his brother’s identifying information to law enforcement.
According to a Chillicothe Police Department report, officers were dispatched to 27 Western Avenue shortly after 1:13 a.m. on July 14 in reference to a noise complaint involving a gathering at the residence.
While speaking with individuals outside the home, an officer reported hearing someone attempting to climb out of a rear window. The individual then allegedly jumped into nearby bushes and fled through an alley toward Main Street despite verbal commands to stop.
Officers broadcast the suspect’s direction of travel and description. Another officer located a man matching the description near Main Street and Walnut Street. Police said the man continued running before being taken into custody near Fifth Third Bank after a brief foot pursuit.
According to the report, the suspect identified himself using his brother’s information and presented identification belonging to his brother. Officers later determined the individual was actually Damien D. Gutierrez after comparing available records and photographs.
Police said a records check revealed Gutierrez had multiple active warrants, including two through the Ross County Sheriff’s Office and one through the Chillicothe Police Department.
In addition to being served on the warrants, Gutierrez was charged with obstructing official business and falsification for allegedly fleeing from officers and providing false identifying information during the investigation.
Jail records show Gutierrez was also booked on outstanding charges including domestic violence, having weapons while under disability, failure to provide change of address, obstructing official business, and falsification.
Gutierrez was transported to the Ross County Jail without incident and was scheduled to appear in court later Tuesday morning.
As with all criminal cases, the allegations contained in the report are accusations, and Gutierrez is presumed innocent unless proven guilty in a court of law.
