Ross County’s felonious assault case against a Bainbridge man accused in a June shooting was dismissed last month, but Phillip L. Dragston II remains in the Ross County Jail.
Dragston, 43, was arrested June 8 and booked into the Ross County Jail. The current jail roster lists him on felonious assault charges with a $250,000 cash or surety bond, plus a hold for the Highland County Sheriff’s Office.
Court records show the case against Dragston, 26CR000268, was filed in Ross County Common Pleas Court on June 24. A grand jury indicted him June 26 on five counts of felonious assault, all second-degree felonies, and the case was assigned to Judge Matthew S. Schmidt. The charges stemmed from a June 8 incident on Free Lane in Bainbridge. Heritage Headlines previously reported on the indictment in June.
On Sept. 28, the state moved to dismiss the case, and the court dismissed it without prejudice. Bond was released and costs were taxed to the state. A Sept. 29 docket entry marked the case over. The dismissal came about two weeks before a jury trial that had been scheduled for Oct. 6-8. Because the dismissal was without prejudice, prosecutors could refile the charges.
All charges are allegations, and Dragston is presumed innocent unless and until proven guilty in a court of law.
