Early Release Ends With 604-Day Prison Term for Dayton Man

A Dayton man who previously received judicial release from prison has been ordered back to prison after admitting to violations of his community control sanctions.

Kelvin D. Johnson, 39, was taken into custody on June 11, 2026, after a capias warrant was served by the Ross County Sheriff’s Office. Jail records show Johnson is currently being held in the Ross County Jail without bond.

Johnson’s incarceration stems from a 2023 Ross County felony case that resulted in convictions for Failure to Comply with the Order or Signal of a Police Officer, Having Weapons While Under Disability, Tampering with Evidence, and Breaking and Entering.

According to court records, Johnson was granted judicial release on Nov. 14, 2024, before completing his prison sentence. As part of that release, the remainder of his prison term was suspended and he was placed on community control for two years. Conditions included reporting to probation, complying with treatment recommendations, and following all court-ordered requirements.

On May 12, 2026, the Ross County Probation Department filed a petition alleging Johnson violated the terms of his community control. The court subsequently issued a capias warrant, and his community control status was suspended pending further proceedings.

The warrant was executed on June 11, and Johnson was brought before the court on the alleged violations. During subsequent proceedings, Johnson admitted to the violations.

On June 26, Ross County Common Pleas Court revoked Johnson’s judicial release and ordered him to serve the remainder of his original prison sentence. Court records show Johnson was sentenced to serve the remaining 604 days of his sentence, with credit awarded for time previously served.

The case highlights the consequences offenders can face when community control conditions are violated after receiving early release from prison.
